What is the Visa/Mastercard, Payment Card Interchange Fee Settlement?

What is the current status of the Payment Card Interchange Fee Settlement?

All appeal periods have passed, and the parties are now preparing the administration of the claims process, starting tentatively December 1, 2023. Claims notices were mailed out to all known Class Members starting December 2023 and into January 2024 on a rolling basis.

Who is eligible to claim funds from the settlement?

All business/merchant who accepted Visa and Mastercard branded cards in the United States any time from January 1, 2004, to January 25, 2019 may be eligible to submit a claim to recoup funds. 

 

All eligible merchants and businesses should receive a notice in the mail explaining the lawsuit, the proposed settlement, the benefits available, eligibility for those benefits, and how to get them. If you did not receive a notice in the mail that does not mean you aren’t eligible. You may still submit a claim online or inquire with the Gravity Recovery Team. Read more about the notice, here.

How do I file a claim?

Claims forms have been available online since December 1st, 2023. A claim must be filed in order to receive any potential funds from this settlement. Merchants do not have to sign up for a third-party service like the one Gravity is offering to participate in the Settlement.

As an eligible merchant, you are not required to use a third-party recovery service. You can submit a claim on your own, at not cost to you with the Claims Administrator and lawyers representing the merchants as a class. Visit the Official Court-Authorized Settlement Website for more information.

If I use Gravity's Recover Service, when do I need to submit a claim by?

In order to allow enough time for the claims process to be complete, our team asks you inquire about submitting a claim no later than July 30th 2024. This will allow the Gravity team time to file on your behalf and ensure the best outcome for you.

 

As an eligible merchant, you are not required to use a third-party recovery service. You can submit a claim on your own. the current deadline for self submissions is Feburary 4th 2024. See details here.

What is Gravity's contingent fee for using the Recovery Service?
If you utilize Gravity’s recovery services and your business is awarded a settlement amount, Gravity will collect 25% of the awarded amount as their fee.

If you utilized Gravity’s recovery services and your business does not receive any awarded amount, Gravity will receive no compensation.

How much money will I get?

The amount paid from the settlement will be based on the actual or estimated interchange fees attributed to Visa and Mastercard transactions between January 1, 2004 and January 25, 2019. 

 

This settlement operates on a fixed fund basis. Those submitting claims may receive a fraction of their estimated interchange fee volume during the settlement period. Currently, there’s no way to accurately project how much money you could get back. Learn more here

What is the Gravity Payments Recovery Service?

Our team provides end-to-end claims service with a contingent fee basis – if there is no recovery of funds, there is no fee. What we do: 

  • Acquire as much of the historical data applicable to the settlement
  • Fill out all the necessary documentation
  • Submit a comprehensive claim on your behalf
  • Reconcile returns on your behalf
  • Distribute net recoveries from the settlement funds back to you
